WNBPA blocks partners from selling Sophie Cunningham viral point, but individual NIL remains open

Source: Front Office SportsFull story →

Front Office Sports reported that the WNBPA is prohibiting licensees from using Sophie Cunningham's viral point at DeWanna Bonner on products. The union told FOS it generally does not monetize player conduct from confrontations between members through licensed apparel. The WNBPA has licensed partners including 2K, Breaking T, Lids and Panini. The union's decision does not stop Cunningham from creating or licensing her own product through her individual NIL rights. Brands that want WNBA team logos or league marks would still need separate approval from the league.

THE BREAKDOWN

Viral athlete moments can split into union rights, league rights and individual NIL rights within hours. Agents should move quickly to identify which part of a moment the athlete controls and which parts require group licensing or league approval. If a brand wants the meme without team marks, individual NIL may be enough, but the creative still needs risk review. Athletes should pre-negotiate approval workflows for viral moments with reps so deals do not stall while attention fades. Brand managers should budget for separate rights clearances when a social moment includes uniforms, opponents, league footage or confrontation context.
