SBA guidance gives creators a clearer industry code, not automatic financing

Source: DigidayFull story →

Digiday's October 28 explainer examines the Small Business Administration's October 15 guidance for US creator businesses. The agency directs creators toward NAICS code 5121, Motion Picture and Video Industries, to reduce uncertainty on applications. Creators already qualified for support when they met the relevant program requirements, so the guidance does not create automatic loan eligibility. The SBA's 7(a) program has a $5 million maximum, while its microloan program offers loans of $50,000 or less. A separate proposed size-standard exception remains subject to a public comment period that closes November 20.

THE BREAKDOWN

Have a US client's accountant confirm the appropriate classification and current eligibility before introducing financing as an option. Compare the lender's repayment terms and personal guarantees with any offer to buy future platform revenue. Do not use a program maximum as a realistic borrowing estimate for a particular creator. Keep this distinction clear in client advice: the guidance addresses paperwork, while a lender still has to approve the business and its ability to repay.
